1. Contractual Partner

Your rental contract is concluded with pension-bahnmeister.de, Bahnhofstr. 47, 07330 Probstzella (hereinafter referred to as “Bahnmeister,” “we,” “us”).

2. Scope of Application

2.1 These general terms and conditions in their version valid at the time of the respective contract conclusion apply exclusively to all mutual claims arising from or in connection with a contract between customers (hereinafter referred to as “Customer,” “You”) within the meaning of § 14 BGB and Bahnmeister. Deviating terms and conditions of the Customer do not apply unless Bahnmeister has expressly agreed to their applicability in writing in advance. This exclusion also applies in cases where Bahnmeister accepts and executes the Customer’s order with knowledge of the deviating terms without reservation. If the Customer wishes to use a service offered by Bahnmeister in addition to ordering goods, the specific terms and conditions for those services shall apply. These conditions are listed with the respective services and apply alongside the terms stated below when using the particular service.

2.2 In the event of conflicting provisions, the following hierarchy applies:

  1. Special terms and conditions for individual services
  2. These general terms and conditions/business clients
  3. Statutory provisions

3. Subject Matter of the Contract / Conclusion / Storage of Contract Text

3.1 The contract is concluded by Bahnmeister’s acceptance of the Customer’s order. The Customer waives receipt of a declaration of acceptance as per § 151 sentence 1 BGB. Acceptance by Bahnmeister occurs through booking by Bahnmeister or upon execution of the services for the Customer.

3.2 The binding language of the contract is German.

3.3 Bahnmeister stores the contract text and sends the booking details to the Customer via email. The terms and conditions (AGB) can be accessed at any time on pension-bahnmeister.de.

4. Prices, Payment Methods / Terms

4.1 The prices listed are net prices, and the applicable statutory VAT must be added.

4.3 The invoice will show both the net price of the service and the prices of supplementary services, as well as the VAT valid at the time of invoicing.

4.4 Invoice amounts must be paid in full before arrival and transferred to the account specified in the invoice.

4.5 You can pay via advance bank transfer, AirBnB, or Booking.com.

4.6 Payment by credit card is only possible through AirBnB or Booking.com.

4.7 Payment via third-party providers and booking platforms

When booking through third-party providers and booking platforms (e.g. Booking.com or AirBnB), the relevant agreements with these providers apply.

5. Voluntary Cancellation

Bahnmeister offers you the option to cancel without providing reasons up to 48 hours before arrival (3 PM on the day of arrival). There is no right of withdrawal if Bahnmeister has fully performed the service or has already started the execution.

6. Unavailability of Booked Rooms or Services and Force Majeure

6.1 If, after receiving the booking, Bahnmeister discovers that the booked rooms or services are no longer available or can only be provided with a delay, they will promptly inform the customer. The customer may withdraw their offer. Bahnmeister will promptly refund any payments already made. If the customer wishes to uphold the booking, Bahnmeister may offer an equivalent room or service in terms of quality and price.

6.2 In cases of force majeure—such as natural disasters, accidents, war or the threat of war, epidemics, labor disputes (including in supplier companies)—which are unforeseeable and unavoidable for Bahnmeister, they are entitled to delay fulfillment of the contract for up to two months from the booking date. The customer will be informed immediately. If the customer does not agree to the delay, they may withdraw from the contract. Any reciprocal payments made will be refunded immediately. Compensation claims in such cases are excluded.

6.3 In the case of unlawful labor disputes, Bahnmeister is only liable for gross negligence.

7. Liability

7.1 Bahnmeister is liable for intentional misconduct and gross negligence in cases of breach of duty, delay, impossibility, tort, and other legal bases (except for pre-contractual breaches). Liability also applies in cases of culpable harm to life, health, or body; in the event of culpable breach of essential contractual duties (cardinal obligations); fraudulent misrepresentation; or in cases of compensation claims under § 437 para. 2 BGB. For breaches of cardinal obligations, Bahnmeister’s employees are liable only for typical, foreseeable damages. Cardinal obligations refer to essential duties whose fulfillment is necessary for the proper execution of the contract and on which the customer may regularly rely. In the event of delay, the customer may alternatively withdraw from the contract.

7.2 Bahnmeister is liable for data loss only if the business customer has demonstrably backed up data daily. Liability is limited to restoration costs assuming a backup exists, unless Bahnmeister caused the data loss intentionally or through gross negligence. Otherwise, liability is excluded.

7.3 Liability under the Product Liability Act remains unaffected.

7.4 These provisions outline the full scope of Bahnmeister’s liability. Any further liability is excluded.

8. Choice of Law

The legal relationships between Bahnmeister and the customer, including these General Terms and Conditions, are governed by German law. The UN Convention on Contracts for the International Sale of Goods (dated April 11, 1988) does not apply.

9. Miscellaneous

9.1 The customer is not entitled to offset or withhold payment unless the claim is undisputed or legally established by a court.

9.2 The place of performance for payments is Bahnmeister’s business location.

9.3 If any part of the contract becomes wholly or partially invalid or loses validity later, the remaining provisions remain unaffected. In such a case, the parties agree to replace the invalid provision with a valid one that, to the extent legally possible, most closely reflects the economic intent of the original clause. This also applies to gaps not foreseen by the parties.

9.4 If the contractual partner is a merchant under the HGB, a legal entity under public law, or a public-law special fund, the exclusive place of jurisdiction for all disputes arising from or relating to this contract is Saalfeld/Saale. Bahnmeister may also choose another legal venue.
